Impact of New Regulations under Digital Personal Data Protection Act 2024 on AI Deployment in India

In a significant move impacting the artificial intelligence (AI) landscape in India, the Digital Personal Data Protection Act of 2023 has ushered in a new era of regulations for companies deploying AI models. Effective as of February 29, 2024, these regulations mandate that companies seeking to launch AI models in India must obtain approval from the Indian government. This requirement reflects a heightened level of scrutiny and control over AI product launches, with companies now obligated to comply with detailed guidelines.

One of the key aspects of these regulations is the requirement for companies to submit comprehensive reports to the government within 15 days of launching AI models. This step is aimed at regulating the deployment of unverified AI platforms on the Indian internet, emphasizing the importance of obtaining permission, proper labeling, and ensuring user consent for untested platforms.

The government’s advisory accompanying these regulations specifically targets large platforms while excluding startups. It includes provisions that prohibit the dissemination of illegal content such as defamation, pornography, and disinformation, as well as any material that poses a threat to India’s unity and sovereignty.

Furthermore, the government has outlined a set of specific rules for AI in India, including the National Artificial Intelligence Strategy, Principles for Responsible AI, Operationalizing Principles for Responsible AI, the Digital Personal Data Protection Act, Information Technology (Intermediary Guidelines and Digital Media Ethics Code) of 2021, and the Draft National Data Governance Framework Policy.

Issued on March 1, 2024, the government’s AI advisory imposes a requirement for significant platforms to seek prior permission from the government before launching AI products. This measure is aimed at preventing the deployment of unverified AI platforms on the Indian internet, with exemptions granted to startups.
